E-Discovery is now a reality for all organizations. There is no such thing anymore as a lawsuit or internal investigation that doesn’t involve at least some E-Discovery. ESI contains contractual, financial, operational and human resource information and exposes all organizations to legal risk. ESI is also no longer considered to be just email and as such, other content sources such as files and instant messages need to be discoverable. The Federal Rules of Civil Procedure updated in December 2006 in the U.S, eliminated the traditional excuses companies have used for not being able to find ESI.
